- The Department for Business, Energy and Industrial Strategy has published a consultation on a Draft Code of Practice on dismissal and re-engagement of employees.
- This comes about following the P&O Ferries debacle where the company dismissed 800 employees without adhering to legal obligations in regard to the redundancy process.
- The Draft Code of Practice details good practice to follow when an employer is looking to change the terms and conditions of its employees, including the requirement to follow due consultation.
- Whilst the Code would not impose any new legal obligations, it would be admissible in court and tribunal proceedings. This means that, in a claim for unfair dismissal, where it could be shown that an employer or employee had failed to follow the code, the tribunal would be able to adjust any award to reflect this fact.
